Eligibility Requirements.
To be eligible for a VAWA self-petition, you must be married to a U.S. citizen or lawful permanent resident who has subjected you to assault or extreme cruelty. You must also be able to show that you entered into a bona fide marriage, i.e., that you did not marry solely for immigration purposes.

The VAWA self-petition process is confidential and you do not need your abusive spouse’s cooperation or knowledge to file a petition. You can also file a self-petition even if you are divorced from your abusive spouse, as long as the divorce is related to the abuse.

Filing Process
To file a VAWA self-petition, you must complete and submit Form I-360 to the U.S. Citizenship and Immigration Services (USCIS). You must also include evidence that you meet the requirements, such as police reports, medical records, and affidavits from witnesses who can attest to the abuse.

If USCIS approves your self-petition, you may be able to apply for lawful permanent residence (green card). If you are in removal proceedings, you may also be eligible to apply for a stay of removal while your self-petition is pending.

      Her professional path began with prestigious legal clerkships and internships, including the United States District Court for the District of Utah and the Utah State Bar Office of Attorney Discipline, where she drafted judicial recommendations, prepared legal memoranda, assisted in civil and criminal litigation, and gained exposure to high-level legal systems.

      In her early practice, she worked with respected firms such as Paul Barton, Estate Planning Attorney, David Paul White & Associates, and Olson Associates, P.C., where she strengthened her skills in trial work, appellate practice, estate planning, civil litigation, and legal research. This foundation would later support her transition into full-time immigration work.

      Atty Gonzalez’ passion for immigrant rights became unmistakable during her years at the Multi-Cultural Legal Center. Beginning as a Staff Attorney and later serving as Executive Director, she provided direct legal services in both civil rights and immigration law. She supervised staff and volunteers, collaborated with private attorneys and nonprofit organizations, and led community legal education efforts.
